1. Introduction
These Terms & Conditions ("Terms") govern your use of the iView Learning platform ("Service"), including all videos, training materials, and interactive resources. By creating an account, activating a licence, or accessing the Service, you agree to comply with these Terms.
If you do not agree, you must discontinue use immediately.
2. Definitions
- "Service" – The iView Learning online training platform and associated applications.
- "User" / "You" – Any individual accessing the Service under a valid licence.
- "Organisation" – Any institution, employer, university, training provider or entity purchasing licences for their users.
- "Content" – All videos, documents, training modules, assessments, scripts, and digital assets supplied through the Service.
- "We", "Us", "Our" – iView Learning Ltd, United Kingdom.
3. Licence & Permitted Use
3.1 Licence Grant
iView Learning grants you a limited, non-exclusive, non-transferable, non-assignable, revocable licence to use the Service strictly for personal study, workplace learning, or organisational training during the active subscription period.
3.2 What You Must Not Do
You must NOT:
- Share, resell, assign, gift, or transfer your licence or access to anyone else.
- Allow another person to log in using your account.
- Copy, record, download, reverse engineer, or redistribute any Content.
- Use the Service for commercial training without a separate written agreement.
- Access the Service for competitive analysis, benchmarking, or developing a similar product.
4. Non-Transferability of Subscriptions & Licences (Strict Clause)
All iView Learning licences and subscriptions are strictly non-transferable under any circumstances.
This means:
- Licences cannot be moved to a different person, student, employee, contractor or device for the purpose of reassigning the user.
- If a user leaves employment/education, the licence cannot be reallocated or reassigned to a replacement.
- Licences cannot be resold, traded, exchanged, or gifted.
- Licences cannot be transferred due to organisational changes such as restructuring, mergers, staffing changes, or role reallocations.
- Subscriptions cannot be paused, carried forward, exchanged, or converted into account credit.
If a replacement user is required, a new licence must be purchased.
No exceptions will be granted unless explicitly authorised in writing and signed by an iView Learning Directors.
5. Account Registration
- Users must provide accurate registration details.
- You are responsible for safeguarding your account credentials.
- Organisations managing accounts must ensure only authorised individuals receive access.
6. Service Availability
- We aim for continuous availability but may temporarily suspend access for maintenance, updates, or security requirements.
- We are not liable for downtime caused by hosting providers, internet issues, or force majeure events.
7. Content, Updates & Intellectual Property
- All Content is owned by iView Learning Ltd.
- We regularly update training materials and platform features.
- You obtain no ownership rights to the Service or Content.
- You may not copy, download, distribute, or recreate any Content.
8. Accessibility
The platform is designed to meet accessibility best practices and supports a range of learning needs. We actively welcome accessibility feedback to improve user experience.
9. Data Protection & Privacy
- We process personal data (name, email, learning progress, login activity) solely to deliver the Service.
- Data is securely stored on UK infrastructure and encrypted in transit and at rest.
- We comply with UK GDPR.
- Full details are provided in our Privacy Notice and Data Processing Agreement.
10. Payment, Fees & Renewals
- All fees are due as specified in your purchase or licence agreement.
- All payments are non-refundable and non-transferable.
- Unused access periods cannot be credited, exchanged, reassigned, or transferred.
- Renewal pricing may change; organisations will be notified in advance where applicable.
11. Organisation Responsibilities (for Institutional Licences)
Organisations purchasing multiple licences agree to:
- Ensure only authorised individuals access the Service.
- Not reassign or transfer licences between users.
- Maintain internal processes to manage user accounts responsibly.
- Inform iView Learning of any suspected misuse.
12. Prohibited Behaviour
Users must not:
- Upload harmful, illegal, infringing, or offensive materials.
- Attempt to bypass security protocols.
- Use the Service to harm, impersonate, or mislead others.
- Use automated systems to extract Content or scrape platform data.
13. Termination
We may suspend or terminate access if:
- You breach any of these Terms.
- You attempt to transfer or share access credentials.
- Your Organisation fails to pay subscription fees.
Termination does not entitle you to a refund, credit, or replacement licence.
14. Limitations of Liability
We are not liable for:
- Indirect or consequential losses.
- Data loss caused by user actions.
- Service interruptions caused by external factors.
Nothing in these Terms limits our liability for fraud or personal injury caused by negligence.
15. Support
Support is available via our helpdesk or via your organisation's designated administrator. Enhanced support may be provided under a separate Service Level Agreement.
16. Changes to Terms
We may update these Terms as reasonably required.
Continued use of the Service after updates constitutes acceptance of the revised Terms.
17. Governing Law
These Terms are governed by the laws of England and Wales.
All disputes will be handled exclusively in UK courts.
